Griffith was arrested outside of a grocery store in Cary, North Carolina last October, and taken into custody.

He posted a $10,000 bond and was released, though he revealed a few days later in an interview with TMZ that the arrest shouldn’t have happened because he wasn’t even in the car.

He revealed there was a call of a man sleeping behind, or inside, his car, but by the time the cops go there, Griffith claims he was already walking away from the car for five minutes when the police brought him back.

‘I pretty much practically told them I didn’t want to deal with them and I said everything was fine,’ Griffith said.

He added he was ‘going ahead and meeting some friends’ so he locked his doors and was walking down the street, and five minutes later he got ‘pulled over by a police officer.’

Griffith added that the cops told him to ‘walk back to your vehicle’ and he denied that he was sleeping or operating the vehicle.

The cops then gave him a field sobriety test, with Griffith adding he thought, ‘they were highly subjective as to whether I was passing or failing.’

They placed him under arrest for DWI, which prompted him to ask the cops how they could arrest him if he wasn’t operating the vehicle and it wasn’t turned on.

The cops told him that, ‘we have witnesses saying you were asleep behind the wheel with the vehicle turned on.’

He said that ‘obviously’ wasn’t true because, ‘I could not even get into my vehicle,’ and he asked the cops to arrest him for ‘public intoxication.’

Despite his pleas, the cops arrested him for DWI in October, and now he’s a wanted man in North Carolina.

Griffith was locked in a nasty custody battle with Griffith over their son Kaiser, which was ultimately settled in October.
